Do "The People" really has the right to bear arms under the Constitution?
Or is that the "militia" which has an absolute right? Amendment 2 reads: "A well regulated militia, being necessary to the security of a free State, the right of people to keep and bear arms shall not be infringed. Currently, five federal appellate circuits have interpreted the law is collective – which means, to approve the state militias – while two (5 and DC) have been interpreted as an individual right held by citizens. The others have not addressed this issue. But more important than the collective against the individual rights argument is that the 2nd amendment (as the 7th) has never been established by the 14th to apply against States – which means that currently, the amendment limited federal laws on gun control, not state law. However, – the Court is faced arguments of these interpretations this term – so the answer may be different after this matter is decided.
